תקנון מבצע שופינג IL (להלן: "המבצע")

 

הגדרות:

"עורכת המבצע" -  חברת _ש.שניצר תכשיטים בע״מ ח.פ __51583271__ עורכת" "הטבה". 

"ההטבה"  - המשתתף במבצע זכאי לרכוש פריטים נבחרים בהנחה של 30% ממחירם המקורי.

2.  פרשנות 

2.1 בכל מקרה של סתירה ו/או אי התאמה כלשהי בין הוראות תקנון זה לבין פרסומים אחרים כלשהם בדבר המבצע, תגברנה הוראות תקנון זה לכל דבר ועניין. 

2.2 החלוקה לסעיפים וכותרות הסעיפים הינם לשם נוחיות בלבד ולא ישמשו לצרכי פרשנות. 

 

3. תקופת המבצע 

המבצע יחל ביום 16/11/23 ויסתיים ביום 23/11/23 (להלן: "תקופת המבצע") או עד גמר המלאי

מובהר כי עורכת המבצע רשאית להאריך, לקצר, לשנות או לבטל את תקופת המבצע, הכול על-פי שיקול דעתה. 

 

4.  תנאי השתתפות במבצע

4.1 עורכת המבצע מזמינה את המשתתף ליהנות מהטבה של קבלת הנחה, כך שבכל רכישה של פריטים נבחרים מהמותג יהיה זכאי להנחת של 30% ממחירם המקורי (במעמד הרכישה, ההטבה כפופה למלאי כמפורט לעיל)

4.2 יודגש כי לצורך קבלת ההטבה יש לרכוש פריטים המשתתפים במבצע בלבד ולא פריטי שירות – גיפט כארד, שירות תיקונים, ערכות ניקוי וכו'.  רשימת הפריטים המלאה מופיעה בנספח.

4.3 ללא כפל מבצעים והטבות

4.4 אין אפשרות להחליף את ההטבה ו/או להמיר את ההטבה בשווה-ערך אחר. 

4.5 במקרה של החלפה ו/או החזרת מוצר שנרכש במהלך תקופת המבצע, ערכו של המוצר הכספי, לצורך חישוב הזיכוי ו/או ההחזרה, יהיה שווה לערכו של המוצר כפי שנרכש בתקופת המבצע, בכפוף למדיניות החברה  ולהצגת חשבונית, גם אם בעת ההחזרה ו/או ההחלפה יהיה ערכו של המוצר שונה. 

4.6 ביטול עסקה, מלא או חלקי, הינו בהתאם לתקנות הגנת הצרכן (ביטול עסקה) תשע"א.2010- במקרה של ביטול מלא יוחזר בהתאם לחיוב בחשבונית. במקרה של ביטול עסקה חלקי – ההטבה מבוטלת ויש להחזיר את הפריטים שניתנו בהנחה או ששווים המלא יקוזז מסכום ההחזר.

4.7 החלפות יהיו בהתאם למדיניות החברה. החלפת מידה תתקיים בהתאם למלאי, לא יבוצעו העברות. 

4.8 חרף האמור בסעיף זה לעיל, מובהר כי עורכת המבצע שומרת לעצמה את הזכות לשנות את ההטבה מכל סיבה שהיא ובכל עת ו/או להתנות את הענקת ההטבות בתנאים על פי שיקול דעתה הבלעדי ללא מתן הודעה מראש. 

 

5 שונות 

5.1 בהשתתפותו במבצע מסכים, מאשר ומצהיר המשתתף ו/או הרוצה להשתתף כי קרא את התקנון, הוא מבין אותו ומקבל על עצמו את מלוא הוראותיו וגם אם לא קרא את התקנון, מסכים המשתתף ו/או הרוצה להשתתף כי תקנון זה יחול עליו ויחייבו לכל דבר ועניין.

5.2 עורכת המבצע תהא רשאית להאריך ו/או לקצר את תקופת המבצע על פי שיקול דעתה הבלעדי ללא מתן הודעה מראש. 

5.3 עורכת המבצע רשאית להפסיק בכל עת, ולאלתר, מכל סיבה שהיא לפי שיקול דעתה המוחלט והבלעדי, את המבצע ו/או לשנות את כל תנאיו או חלק מהם (לרבות שינוי ההטבות). כמו כן עורכת המבצע שומרת לעצמה את הזכות, לפי שיקול דעתה המוחלט, לשנות את תנאי התקנון מפעם לפעם על פי שיקול דעתה הבלעדי וללא הודעה מוקדמת. החל ממועד שינוי התקנון יחייב הנוסח החדש, נוסחו המחייב של התקנון הוא זה שיהא מצוי מעת לעת במשרדי עורכת המבצע. .

5.4 עורכת המבצע תהא הפוסקת הסופית בכל עניין הנוגע למבצע ובנוגע לכל שאלה שתתעורר במהלכו ו/או בקשר עמו ובנוגע לכל תקלה ו/או בעיה ו/או כל מצב בלתי צפוי שייווצר במהלך המבצע, בין אם צוינו במפורש בתקנון זה ובין אם לאו ולמשתתף לא תהיה כל טענה בשל כך. 

5.5 הדין החל על תקנון זה ועל כל הנובע ממנו יהיה הדין הישראלי בלבד, ולא יחול כל דין אחר. 

5.6 תקנון זה מנוסח, משיקולי נוחות בלבד, בלשון זכר. ההשתתפות במבצע, בהתאם להוראות תקנון זה, מיועדת לגברים ולנשים. .
5.7 ניתן לעיין בהוראות תקנון המבצע בתיאום מראש במשרדי החברה ז’בוטינסקי 1 רמת גן, בניין מכבי קומה 12

1. General

 

These Terms of Use is a legal agreement between you (the “User” or “Client”) and "S.SCHNITZER" (the “Company”), regarding the use of this Website (the “Website”). These terms also apply to any updates, supplements, web content or Internet-based services.

 

1.  Definition: “Product” refers to the jewelry or other paraphernalia Company subjects to sale.

 

1. BY USING THIS WEBSITE, YOU ACCEPT THESE TERMS OF USE. IF YOU DO NOT ACCEPT THESE TERMS OF USE, PLEASE DO NOT USE AND/OR ACCESS THE WEBSITE. 

 

1.  For the avoidance of doubt, it is required for you to do your due diligence to acquire the knowledge that the Products or services are compliant with your country laws and regulation – this also reduces the risk for having to recall a Product in the future.

 

1. The Company reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for any changes. Your continued enrollment following the posting of changes will mean that you accept and agree to the changes.

 

1. Any activity made on the Website and any legal grounds arising from the use of the Website, including the validity and interpretation of these Terms of Use, will be governed only by Israeli law regarding both content and local authority.

 

1. Use of this Website

 

1. All prices listed on the Website of the Products are denominated in NIS and including VAT (value added tax). The Company may update the Product prices from time to time and the shipping rates without any prior notice. Please note that the valid price for every Product is the price published when completing the order process. 

 

1. The Company endeavors you to be updated with the prices of the Products and shipping fees which appear on the Website in real time. However, it is clarified that a temporary gap may arise between the price when collecting the Product (which appears in the shopping cart) and the price which appears when completing an ordering process. For the avoidance of doubt, it is hereby clarified that the Company shall not bear any responsibility arising from and/or related to such price disparities.

 

1. The Company does not undertake to keep stock of all models and/or Products whose pictures appear on the Website, and that the images on the Website are for illustrative purposes only. It should be emphasized that there may be differences in color and/or dimensions and/or other changes between the appearance of the Products on the Website and the physical Products. 

 

1. The Company reserves the right to offer promotions, benefits and discounts at its sole discretion. In addition, the Company may at any time discontinue, exchange and/or change these promotions, benefits and discounts, without any prior notice.

 

1. You may not attempt to gain unauthorized access to any portion or feature of the Website, or any other systems or networks connected to the Website or to any Company server, or to any of the services offered on or through the Website, by hacking, password "mining" or any other illegitimate means.

You may not use any "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Website or any content, or in any way reproduce or circumvent the navigational structure or presentation of the Website or any content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Website. The Company reserves the right to bar any such activity in whichever way the Company deems reasonable.

 

1. You may not probe, scan or test the vulnerability of the Website or any network connected to the Website, nor breach the security or authentication measures on the Website or any network connected to the Website.

1. You may not use the Website or any content thereof for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of Company or others.

 

1. You may use the Website for your personal use only. It is strictly prohibited to use the Website for any purpose other than personal and non-commercial use. In addition, it is strictly prohibited to use any content, text, names or any other material appearing on the Website except for the purpose hereof.

 

1. For the avoidance of doubt, users under 18 years of age are required to notify their parents of these Terms of Use and obtain consent to use the Website. Any entry and/or use and/or activity of a minor on the Website indicates the consent of the minor's parents to these Terms of Use.

2. Order Placement

 

1. To ensure order fulfillment as soon as possible, users must supply all required information on the Website, including name, address, email address, telephone number and credit card. Any information that is incorrectly inputted is the sole responsibility of the client and not assumed by the Company in any form, including but not limited to the repercussions of this, such as a delayed or lost package. 

 

1. In case the transaction is not approved by the credit companies, the purchase will not be completed, and the user will receive an appropriate notification. For the avoidance of doubt, transaction will only be completed after the credit company has approved the wire.

 

1. Please note that approval of the purchase is subject to the Product's availability at the Company’s inventory and there may be situations where a specific item is missing. In this case, Company will cancel the purchase and return the payment to the user (if paid). 

 

1. Company charges sales tax for merchandise ordered on the Website based on the applicable sales tax rate of the location to which the order is being shipped. Prices of Products featured on the Website are subject to change at any time without notice.

 

1. Company reserves the right to amend pricing and/or cancel any order you have placed if there was an error concerning the price or availability of any item; if your credit card has already been charged for the purchase and your order is cancelled, Company will issue a credit to your credit card account in the amount of the charge. 

 

1. Promotions that are available through the Website may be governed by rules that are separate from these Terms. All Promotions are subject to Company rules and regulations posted at the time the Promotion occurs. 

 

1. Cancellations and Returns

 

1. Cancellation shall be subject to the Israeli Consumer Protection Law, 5741–1981 (hereinafter: the “Law”). Accordingly, a replacement will be given solely if the package arrives with significant manufacturing damage such as a fracture or a dent that was not caused by the client in any way. No credit will be given for unpaid items such as promotional offers and vouchers. It is clarified that no returns will be permitted for any reason.

 

1. In the event that the package has been ordered but not shipped out for delivery yet, the order may be canceled. However, if the client wishes to cancel the package after it has already been shipped out, there will be no return nor refund permitted.

 

 

 

 

1. Shipping and Delivery

 

1. The Company will work to deliver the Products in accordance with the terms of delivery stated on the sales page. Product delivery times will include only the business days calculation (Monday through Friday, excluding Holidays). Please be advised that Company currently ships from the Website to the state of Israel. Orders in the current shipping process cannot be amended.

 

1. Delays in delivery due to any issue within the client’s control such as unavailability by phone, incorrect address or contact details are the client’s responsibility and not the fault of the Company in any way. 

 

1. The Company will not be responsible for the late delivery of the Products in the following cases: (a) Force majeure including war, plague, hostilities, emergency and natural damage; (b) Strike at suppliers of services or goods needed to manufacture supplies and/or transport the Products; (c) Any reason beyond the control of the Company. 

 

1. To verify that the Goods are undamaged, it is recommended to open the package as soon as the    Products are delivered, with the courier in presence. You acknowledge that if you fail to open the         package upon the courier in presence, we may not be able to claim against the courier or the        delivery service. You then agree that you will be liable for the damage of the Products. 

 

1. Limitation of Liability

 

1. Except where prohibited by law, in no event will Company be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if the Company has been advised of the possibility of such damages. 

 

1. The Company is not obligated to replace destroyed or damaged merchandise that occurred while in the possession of the user. This is the responsibility of the client after the content has been received. Additionally, the Company is not liable for any dysfunction on the Website and, while doing what he can to rectify the issue, disclaims all liability for any client’s loss of content or inability to access the Website. 

 

1. The Company assumes no responsibility for any content uploaded by users which are subject to any copyright infringement. In the case that the Company is notified of copyrighted material uploaded to the Website or comes to gain knowledge of this through the Company’s own methods, it will promptly be deleted and removed from the Website. The Company disclaims all liability and responsibility in relation to this. 

 

1.  To the fullest extent permitted by applicable law, in no event will Company, its affiliates, officers, directors, employees, agents, suppliers or licensors be liable to any person for (a): any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use or content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if Company has been advised as to the possibility of such damages or could have foreseen such damages.

 

1.  BY NO MEANS IS THERE A WARRANTY FOR THE PRODUCTS, TO THE EXTENT PERMITTED BY APPLICABLE LAW. UNLESS OTHERWISE DECLARED IN WRITING, S.SCHNITZER, PROVIDE THE PRODUCTS “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY OR NONINFRINGEMENT. FOR THE AVOIDANCE OF DOUBT, THE COMPANY SHALL NOT BE ELIGIBLE NOR OBLIGATED TO THE QUALITY OR THE FITNESS OF THE PHYSICAL PRODUCTS. 

 

1.  You agree to indemnify and hold the Company, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against Company by any Third Party due to or arising out of or in connection with your use of the Website.
